Understanding the Estate's Assets and Debts

Before anything else can move forward, the estate's assets and debts need to be identified accurately. This includes property throughout Mecklenburg County and beyond, financial accounts, and outstanding obligations that will need to be addressed before any distribution occurs.

Personal representatives administering an estate must accurately inventory and value local real property and financial holdings within 90 days of qualification. Additionally, North Carolina law mandates publishing a Notice to Creditors in a locally circulated Mecklenburg County newspaper to open the required 90-day claim window, enabling legitimate debts to be satisfied before any asset distributions are made to beneficiaries or heirs.

Determining Whether Probate Is Required

Not every estate requires the same process, and determining whether probate is necessary, and what type, shapes every decision that follows. We can work with you to review the will and any other relevant legal documents early to help clarify what's actually required.

Real Talk, Legal Insights, and Stories That Matter

Identifying Beneficiaries and Heirs

Confirming who is legally entitled to receive property, whether named in a will or determined by law, needs to happen before distribution, not after.

Knowing What Not to Do Yet

Just as important as knowing the right steps is understanding what shouldn't happen prematurely. Distributing assets, paying certain debts, or making decisions out of sequence can create personal liability for a personal representative acting in good faith but without full guidance.
