Assets, Debts, and Creditor Claims
Accurately identifying the estate's assets and debts is only the beginning. Creditors must be properly notified and given the opportunity to file claims, and those claims need to be evaluated and addressed correctly before distributions occur, whether they involve local Charlotte-area accounts and property or obligations elsewhere.
Court Requirements and Deadlines
Probate comes with specific court filing requirements and deadlines. Missing or mishandling these requirements can slow the process down or create complications that weren't necessary in the first place.
In Mecklenburg County, probate matters are opened and administered through the Estates Division of the Clerk of Superior Court, located at the Mecklenburg County Courthouse in Uptown Charlotte.
Qualifying as a personal representative requires filing an Application for Letters Testamentary or Letters of Administration (Form AOC-E-201 or AOC-E-202) along with the original will and death certificate. If our office is involved early in the process, we can assist you with this.
Once qualified, North Carolina law mandates filing a complete inventory of the decedent's real and personal property within 90 days. Meeting these strict court deadlines prevents inventory delinquencies and keeps estate administration proceeding smoothly through the local clerk's office.
